Agência Nacional de Transportes Terrestres (ANTT) is Brazil's national regulator for the ground transportation sector and it awards infrastructure construction concessions for highways and railways, licenses for highway and railway public transportation, authorization for tourist and freight transport, international cargo and multimodal transport and terminals.

Law No. 10,233, of June 5, 2001, by promoting a restructuring in the federal transportation sector, established, in its article 22, item VII, ANTT's competence to regulate the transportation of dangerous products on highways and railways, establishing complementary technical standards and norms related to this type of operation.

 

The Brazilian regulation on the road transport of dangerous products is based on the international recommendations issued by the United Nations Committee of Experts on the Transport of Dangerous Products, published in the Model Regulation, known as the "Orange Book", updated periodically, as well as in the European Agreement for the Road Transport of Dangerous Products, known as ADR.

It is important to highlight that this regulation is periodically updated by ANTT, based on both the revisions that have occurred in international regulations and on discussions with the regulated sector, which culminate in suggestions for improving the current prescriptions. Such updates are carried out through processes of control and social participation, such as Public Consultations and Public Hearings.

In this sense, in 2022, ANTT, within the scope of the Public Hearing No. 03/2022 process, revised the regulation, publishing, on November 04, 2022, ANTT Resolution No. 5,998/22, updating the Regulation for the Road Transport of Dangerous Products and approving its Complementary Instructions, which will come into force as of June 01, 2023, repealing the current ANTT Resolution No. 5,947/21, applicable until May 31, 2023.

 

Said Resolution establishes, among others, prescriptions regarding the conditions of transport; documentation; duties, obligations and responsibilities; applicable infractions, as well as provides, in the attached Complementary Instructions, on the correct classification of the product; the adequacy, certification and identification of packages and packaging; the signaling of units and transport equipment; documentation; the requirements applicable to road transport vehicles and equipment, limited quantity and special provisions, where applicable.

Finally, on May 15, 2023, ANTT Resolution No. 6,016/23 was published, which amends some points of ANTT Resolution No. 5,998/22.

 POSTAGE OF THE EMERGENCY FORM AND ENVELOPE FOR TRANSPORT

Since the publication of ANTT Resolution No. 5,848/19, revoked by ANTT Resolution No. 5,947/21 And, subsequently, by ANTT Resolution No. 5,998/22, there is no longer a requirement to carry the Emergency Form and its Envelope during the road transport of dangerous products.

ELECTRONIC SUBMISSION OF CERTIFICATES FOR THE TRANSPORT OF DANGEROUS PRODUCTS IN BULK (CTPP, CIPP, CIV)

ANTT Resolution No. 5,998/22 establishes, in its article 11, that vehicles and equipment for transporting dangerous products in bulk must be certified and/or inspected, as detailed below:
I - equipment for transporting dangerous products in bulk must be certified by Product Certification Bodies - OCP accredited by Inmetro for the issuance of the Certificate for the Transport of Dangerous Products - CTPP; and
II - vehicles and equipment for the transport of dangerous products in bulk must be inspected by Accredited Inspection Bodies - OIA accredited by Inmetro for the issuance of the Vehicle Inspection Certificate - CIV and the Inspection Certificate for the Transport of Dangerous Products - CIPP, respectively.
To modernize the issuance and inspection of these documents, ANTT and Inmetro established, under the terms of Inmetro Ordinance No. 144/2019 and ANTT Ordinance No. 637/2020, the electronic submission of information to ANTT.
The ordinance came into force on January 4, 2021 and, from that date, OCPs and OIAs had a period of 90 days to integrate into the ANTT system and carry out the necessary tests. The electronic submission of data by these Bodies has been mandatory since April 4, 2021. Click here to access the Integration Manual with the procedures for sending data.
It is worth mentioning that the issuance of certificates in physical media by OCPs and OIAs, as well as their possession during transport, remains mandatory for the purpose of monitoring the requirements provided for in ANTT Resolution No. 5,9998/22, until the digital certificates are fully implemented.

Resolución 64/2022

The mercosur/cmc/dec decision is incorporated into the national legal system. No. 15 dated december 4, 2019 of the common market council, by which the agreement for the facilitation of land transport of dangerous goods in mercosur corresponding to the 17th un review, protocolized by the latin american integration association -aladi-, as a second additional protocol, on the partial scope trade promotion agreement -aap/pc no. 7 on may 18, 2021, which as annex i, (if-2022- 40140414-apn-cntysv#mtr), integrates this resolution.
